The investigations lasted for more than a year and found “insufficient evidence” to conclude that Bettinger made the “speed bumps” remark as alleged by Bryant. In fact, one investigation found that it was “more likely than not” that Bryant never heard Bettinger make any remark at all.

Despite the lack of evidence against her, Bettinger was still punished by the university for violating its Standards of Conduct. She was expelled in abeyance (meaning that she could still graduate but could not return to campus or participate in any university activities) and required to complete several other sanctions, such as writing apology letters, attending diversity training sessions, and performing community service hours. Bettinger appealed the sanctions but was denied by ODOS.

In August 2021, Bettinger filed a lawsuit against UVA and several administrators, claiming that they violated her First Amendment rights and due process rights. She also claimed that ODOS “purposefully tampered” with the investigations and imposed “arbitrary” and “capricious” sanctions on her.
